Company Terms For Shoot/Rules Of Engagement

Dear Esteem client,

We are deeply honored by your interest and decision to have us handle your brand Photoshoot and creative content. We do not take this opportunity for granted, and in order to provide you with quality service and utmost value for your money, here are a few Terms of Engagement for both Parties to review and agree on.

Terms For Shoot

Client is requiring the Service of MAMAHZ INC. FULL SERVICE CREATIVE AGENCY to create content for her brand and render the following services:

  • Photography
  • Reels Videos
  • Model (s)
  • Hair and Makeup
  • Creative Direction
  • Location (As approved and directed by the client)

Rules For Engagement

  • Client is to Approve and vet all above mentioned services before the shoot day.
  • Client will select and Approve models to be used for the shoot. The Agency will send Model options to the client according to size requested by the client. The agency unless Advised otherwise will NOT choose a model for the client
  • The Client will pick out a Hairstyle according to budget and list of available hairstyles achievable by the creative team. This also applies to the Makeup look. I’m a case where the Client wants a Hairlook or makeup look above the approved Budget, the Client will be sent the cost separately for those looks. The agency will only send recommendations or give suggestions but the ultimate decision on hair and makeup lies with the client. Only vetted hairstyles and makeup looks will be used
  • The Client is expected to send products/outfits for shoot at least 24 hours before proposed shoot date. Any delays before the product arrives will push the production date by one or more days
  • Remuneration: We accept full payment before the proposed shoot date. Acceptable payment plans are 70/30 payment plans. 70% before shoot date confirms booking and 30% balance on the proposed date for shoot. The Agency is at discretion to call off or put the booking on hold where the balance 30% is not paid as at the shoot day. In the event of cancellation, The client is to pay a 20% of total charges as cancellation fees
  • STYLING: The Agency NO longer offers STYLING services. We can only assist with styling materials we already have at the studio. The Client is expected to come with their own styling materials, in event that the client cannot provide styling materials, the agency will draw up a budget for styling according to the client’s style board which the Client will fund
  • The Agency appreciate client IDEAS and inspiration for shoot, but we will communicate clearly what is achievable within our means in event of shoot planning. Client briefs, especially those which involve images and videos from foreign pages and high funded shoots will ONLY be recreated according to what is achievable with client’s budget and available materials. THE AGENCY WILL NOT BE HELD RESPONSIBLE FOR A SHOOT, if it doesn’t look EXACTLY LIKE inspiration images as, props, budget, gears and creatives are different.
  • The Agency only offer Reels Videos as a Free service complimentary to images from shoot. Any other videography service is negotiated separately between client and agency. External creatives may be involved in such situations
  • The Agency holds FULL RIGHTS OF USAGE to all content Created by the Agency on behalf of the Client. The agency can use these content for its marketing promotional activities only. This means we can/will post such content on our social media pages and website, We can use those images for promotional purposes as well as to showcase our work. We shall have our watermark on all content (images and videos) produced by the agency. In the event that the client prefers exclusivity, we shall review accordingly and revert if it’s a job we would like to take on or not. The agency shall not use nor license such client images for unauthorized third party productions
  • If the agency decides to take up such a Job, an Exclusivity fee of N500,000 is to be paid to the agency aside Standard production charges. This is an outright buying out of all content produced by the brand on behalf of the agency including Raw files
  • The agency offers a discount of 10% for outfits above 10. Outfits below 10 are charge at the Standard rates
  • Service Charge covers use for only one Model. Any Extra model comes with an extra charge as shall be advised by the agency.

CONDITIONS FOR RESHOOT

The Agency understand that sometimes things can go wrong in a shoot, and some unforeseen circumstances can cause a shoot to not go as desired. To manage our high valued relationship with our esteemed clients, We do accept events for reshoot, however, here are our CONDITIONS for reshoot

The Agency will only reshoot/Re-edit images if the following happens:

  • If the error is the fault of the production team. This is in regards to picture/video quality, where images come out blurry or dull.
  • If the set Lighting for photos was not done right or key detailed shots were omitted. Specific clients details herein are as agreed with the client and documented before shoot.
  • If model(s) hair/makeup, used was not what was approved by the client.
  • If the client approved theme is different from the production done. For instance, the client approves an indoor/studio shoot and the agency produces an outdoor shoot.

The agency will NOT bear Cost for Reshoot if:

  • There is a styling error: Since we do not offer styling as a service anymore, we encourage that the client brings their own style personnel for the shoot, In a case where there is none, and the agency is working with their in house available styling materials, we need client to vet and approve every look before we shoot
  • If the set Lighting for photos was not done right or key detailed shots were omitted. Specific clients details herein are as agreed with the client and documented before shoot.
  • ) There’s a fluctuation in the model's body size. The agency will not be held responsible for model weight gain or weight loss, as this is beyond the control of the agency, we always prefer clients to pick models (3-5 days) or a few days before the shoot date as models weight can fluctuate and affect the overall turn out of the images
  • If a client “changes their mind” about the mood board after shooting has been produced. In event a client decides to go a different route after a shoot has been produced, the client will bear full cost of the reshoot. (This covers, style of shoot, models chosen, location of shoot, moodboard, choice of background, shoot composites)
  • If the client was unclear with their brief, where the brief was not documented and the client gives the agency creative freedom to produce as best fit, or did not have a brief at all.
  • If the client approves all shoot plans including models, hair and makeup, styling and location for shoot, choice of backdrops, props, background, jewelries and moodboard before shoot
